
FDA Issues Warning Letters to 30 Telehealth Companies Over Misleading Compounded GLP-1 RA Marketing

The US Food and Drug Administration (FDA) has issued 30 warning letters to telehealth companies for false or misleading marketing claims about
Regulators allege that the telehealth firms made unsubstantiated assertions about compounded GLP-1 RA products, including claims implying comparability to approved therapies, such as semaglutide- or tirzepatide-based medications, and about their safety or effectiveness. The warning letters mark a significant enforcement step under the Federal Food, Drug, and Cosmetic Act, with firms given 15 business days to correct violations.1

“It’s a new era of enforcement. We are paying close attention to misleading claims being made by telehealth and pharma companies across all media platforms—and taking swift action,” FDA Commissioner Marty Makary, MD, MPH, said in a press release.1 “Compounded drugs can be important for overcoming shortages or meeting unique patient needs—but compounders should not try to circumvent FDA’s approval process by mass-marketing compounded drugs."
The FDA’s warning letters focus specifically on misbranding and false advertising claims. Compounded drugs—medications prepared by licensed pharmacists to meet specific patient needs—are not evaluated by FDA for safety, efficacy, or quality, and claims that they are “equivalent” to approved GLP-1 RA therapies are potentially misleading to clinicians and patients.1
Physicians prescribing weight-loss or antidiabetes therapies should be aware of the ongoing regulatory scrutiny around compounded GLP-1 RAs and the legal requirement that marketing must not imply comparability with FDA-approved agents. Further enforcement actions could include seizures, injunctions, or other legal remedies if corrective responses are insufficient.1
